<p>A durable power of attorney is a power of attorney by which an adult person, called the &#8220;principal&#8221;, designates another person as his or her &#8220;attorney-in-fact&#8221;. An &#8220;Attorney-in-Fact&#8221; is one who acts as an agent or representative of another and has been given the authority to act in that person???s behalf. </p>
<p>It is a written document and in West Virginia it must contain the words indicating that the Power of Attorney shall not be affected by the disability or incapacity of the principal or that the power of attorney shall only become effective upon the disability or incapacity of the principal. The intention of the principal is that he or she will have an agent to act according to his or her wishes in the event that they are unable to do so.</p>
<p>In West Virginia all acts done by an attorney-in-fact, during any period of disability or incapacity of the principal, will have the same effect and agreements made will be binding to his successors as if the principal were competent and not disabled.</p>
<p>After a durable power of attorney is executed in West Virginia, the court, within the principalâ??s permanent residence, may appoint a guardian or trustee of the estate who would manage all of the principalâ??s property, except for any written specified exclusions. The guardian or trustee has the power to revoke or amend the attorney-in-factâ??s duties.</p>
<p>In West Virginia the principal may also nominate, in his power of attorney document, a guardian of his estate if protective proceedings for the principalâ??s person or estate are recommended or felt to be necessary.</p>
<p>If the attorney-in-fact initiates agreements or contracts, without knowledge of the principalâ??s death, and is acting in good faith for the principal, any action he has taken is valid and binds his successors to such agreements. The same applies to the attorney-in-factâ??s actions when the power of attorney is revoked or terminated. Any commitments made during a time when he is not aware that the power of attorney has been revoked or terminated are valid, legal and binding.

<p>Very new companies and small organizations have to keep a tight lid on expenses. Typically, this means that they simply cannot afford to employ and pay an attorney to prepare, submit, and register their trademarks with the United States Patent and Trademark Office (&#8220;USPTO&#8221;). So they either file a trademark application themselves or use one of the ultra-cheap document assistant services on the Internet (these services are not provided by legal professionals and provide virtually no worth whatsoever). Not surprisingly, in these situations, the initial trademark application is inaccurate in some form.</p>
<p>When the trademark application is sent to to an examining attorney at the USPTO, the examining attorney examines the trademark application for any disorders or challenges. This includes both issues inherent with the trademark being applied for and troubles due to potential confusion with presently existing trademarks that have been filed or registered with the USPTO. The examining attorney then issues a notice known as an office action that sets forth all denials and refusals that must be answered or responded to by the applicant within six months. If the trademark applicant is not represented by an attorney at law, the examining attorney will often include a statement in the office action advising the applicant to obtain the help of an attorney.Upon receipt of the office action, many unrepresented applicants recognize that their choice not to retain an lawyer to help them with the trademark application was a error. Not only will they probably have to hire a trademark attorney anyway to respond to the office action, but the flaws in the initial application may greatly restrict what an attorney at law can fix at this point in the procedure anyway. Added to that, the applicant has spent hundreds of dollars on the trademark application that the USPTO will not return.</p>
<p>Unrepresnted applicants are essentially left with three options. The applicant can simply throw in the towel and abandon the trademark application altogether. The applicant can take on the enormous task of trying to learn trademark law and try to correctly respond to the office action. If an applicant chooses this route, it is best to buy one of the layman friendly guides out there, such as How To Respond to a Trademark Office Action Without An Attorney. Finally the applicant can hire a trademark attorney and spend a ton of money. Often, the realization is hiring a trademark attorney from the outset would have been best.

If you&#8217;re really worried about the legalities of it, I&#8217;d recommend leasing a residential property through a property management company instead if you can afford it.  It&#8217;s a lot cheaper and they can do it for you for as long as you want to lease out your property.  If you change tenants you have to continually hire a lawyer to change the terms on your lease agreement.</p>

<p><i>Answer by M K</i><br/>When you get your license (and you do not need the actual paper, you need just the number) you have to go to C.A.R. office and become a member. This is when you get C.A.R. and NRDS numbers.<br />
After you become a C.A.R. member, which includes membership in National Association of Realtors and your local association, you can register on their Website and download Winforms (all and every official form you need.)  By the way, in most cases you do not even need to download and print those forms, you can fill them out online and then print out. It&#8217;s better than writing in client&#8217;s names, property address, etc. by hand. Of course it&#8217;s a good idea to download the most common blank forms and have them with you, in case you need to write an offer and you are away from a computer.<br />
To make the long story short, get your RE license number, go to C.A.R. office, pay a huge membership fee and you are set.</p>

I&#8217;m looking into estate planning. I have a last will and testament but my wife and I would prefer to do a revocable living trust. Is this something that we need a lawyer for?</p>
<p>The reason I ask is that we were referred to a site by friends last year. They downloaded the forms, filled them in and that was it, at least that is what they said. </p>
<p>We aren&#8217;t sure if that would work for us since we have property in different states. Maybe we can use one joint living trust and put all of our real estate into it. Where can we get more information and is there a good source for a revocable trust online?</p>

<p><i>Answer by Verified</i><br/>You don&#8217;t need a lawyer for a RLT. There are multiple companies on the www that provide them but you really need to get a reputable company. </p>
<p>There is a lot of information on NUPP Legal about RLTs and we refer people to them because they have been around for about 10 years or more.  My first experience with them was a referral from my lawyer for a power of attorney. A few business associates use them for last will and testaments and forming a limited liability company.</p>
<p>I just went to the site and they have the forms for revocable living trusts too. You need to scroll down the page to see the listings of states. Here&#8217;s the page:</p>

<p>Another good thing about them is that you get to save the forms to your computer so you can use them all you want instead of having just 30 days and then repaying.</p>
<p>You, specifically, will need to file a deed for each property you want to put into the trust. Since they are in different states you will need a different deed for each as deeds vary in each state.  The deed for transferring real estate into a RLT has to be one that does not trigger a &#8220;due on sale&#8221; clause if you still have a mortgage on the property. The site I mentioned also has deeds just for such a transfer. Actually, there is a bundle called a living trust toolbox for each state that has deeds and other forms. Looks like the deeds in the bundle are just for the state you order but you can also get the deeds for the other states separately. Here:</p>

<p>Besides, you will also need a pour-over Will to go with the RLT.  That comes in the bundle at NUPP Legal also. Pour-over Wills pay off your expenses and then dump (pour) the rest back into your revocable trust.</p>

This form of bankruptcy in some cases offers a better solution over the conventional form of bankruptcy as listed out by the Chapter 7 bankruptcy. The Chapter 7 bankruptcy can sometimes strip the debtor of his assets. This bankruptcy can be declared by individuals who have a limited regular income and can show ability to pay back a portion of their debts over time. </p>
<p>Understanding the negative aspects of this type of bankruptcy will explain the flexibility of the Chapter 13 bankruptcy. It is seen that a person who has filed for this form of bankruptcy would see it on their credit reports for a period of 7 years.
