Section 4481 of the Internal Revenue Code imposes an annual tax on the use of heavy highway vehicles. This annual tax is reported on IRS Form 2290. Internal revenue service has informed that the law that governs the annual tax imposed on the use of heavy highway vehicle, form 2290 will expire near September 30, 2011. The new IRS form 2290 is not available at this time and has not been published by the IRS for the period beginning July 1 2011. Considering the current scenario, you can expect delay in the filing period for heavy vehicle use tax form 2290. Also we may expect changes in the (to be published) form 2290 as based on our testing for Heavy Highway Vehicle Use Tax for the period 2011-2012 we received a different schedule 1 for 2011-2012 tax year compared to the existing schedule 1 for the tax year 2010-2011 or earlier.
However you can still get your tags for the tax period beginning July 1, 2011. Existing regulations allow states to register heavy highway vehicle when the application for registration is received during the months of July, August or September 2011. If you have your Schedule 1 for the previous year’s taxable period, which in this case is July 1, 2010 through June 30, 2011, then states can accept it as proof of payment.
Moreover, you can get your newly acquired heavy highway use vehicles registered by the state without having proof of tax payment if you present the original or a photocopy of a bill of sale showing that the vehicle was purchased by the owner during the 60 days before the date the state receives the application for registration.
Nonetheless, users should be aware that IRS has strictly recommended that you do not send any old/previous form or payment to the IRS in order to file heavy highway vehicle use tax for period 2011-2012. If you do end up sending the older form, then IRS will apply the payment towards your tax account and will not issue a schedule 1. On the other hand, they will send you a notice to send a new form when it becomes available.
We will keep you all updated on the latest changes as and when we get an update from the IRS but meanwhile if you have already filed your 2290 return for the tax year 2010-2011 then you should contact IRS at 866-699-4096 to get a copy of your schedule 1 or if you have filed through one of the IRS authorized provider such as http://www.greentax2290.com then you need to get in touch with them to get a copy of your schedule 1.
